Welcome to Namaste India. These Terms and Conditions govern your use of the Namaste India website and the purchase of any products from our store. By accessing or using our website, you agree to be bound by these Terms and Conditions and all policies incorporated by reference.

1. The Service and Our Role

Namaste India operates as an intermediary storefront utilizing a Print-on-Demand (POD) model.

Our Role: We are responsible for the design, marketing, and sale of the products displayed on this website.
Fulfillment Partner: All products are produced, packaged, and shipped by a third-party fulfillment partner (Printify and their network). Once you place an order, we transmit the order details to this partner.
Limitation of Liability: You acknowledge and agree that Namaste India is not directly involved in the physical production, quality control of the manufacturing process, or the shipment of the products. While we rely on our partner for high quality, we disclaim all liability for any errors or defects that occur during the manufacturing or shipping process, except as covered under our specific Returns Policy.

2. Product and Order Information

Product Representation: We strive for accurate product display, including colors and sizes. However, we cannot guarantee that your monitor's display of any color or product detail will be accurate.
Print-on-Demand Nature: You understand that when you place an order, the product does not yet exist. It is created specifically for you, which affects cancellation and return policies (see section 4).
Pricing: All prices are subject to change without notice. The price charged will be the one displayed at the time the order is placed.

3. Payment and Order Acceptance

Order Confirmation: Your receipt of an electronic or other form of order confirmation does not signify our final acceptance of your order, nor does it constitute confirmation of our offer to sell.
Right to Refuse: Namaste India reserves the right at any time after receiving your order to accept, decline, or limit your order for any reason, including but not limited to product or pricing errors, suspicion of fraud, or shipping restrictions.
Payment Security: All payment information is processed by secure third-party payment processors. Namaste India does not store sensitive customer payment data.

4. Shipping, Returns, and Cancellations

Shipping: Shipping times are estimates only. Namaste India is not responsible for delays in production, transit, or delivery caused by the fulfillment partner, shipping carriers, customs, or force majeure events.
Returns: Due to the Print-on-Demand nature of our products, our Returns Policy is strictly limited. We generally do not accept returns or exchanges for buyer's remorse (e.g., incorrect sizing, color preference, or change of mind). Returns are only accepted for items that are demonstrably defective, damaged, or incorrect upon arrival, as detailed in our separate "Shipping & Returns Policy."
Cancellations: Orders are sent for production almost immediately. We can only guarantee cancellation requests made within 1 hour of placing the order. After this window, the item is likely in production, and cancellation is not possible.

5. Intellectual Property and Use of the Website

Ownership: All designs, text, graphics, logos, images, and the compilation thereof (the "Content") on the Namaste India website are the property of Namaste India and are protected by applicable intellectual property laws.
Limited License: You are granted a limited, non-exclusive, non-transferable license to access and make personal use of this site. You may not modify, reproduce, sell, or exploit any portion of the website or its Content without our express written consent.
Prohibited Use: You agree not to use the site for any unlawful or prohibited purpose, including transmitting any harmful or malicious code.

6. Governing Law and Jurisdiction

These Terms and Conditions and any separate agreements whereby we provide you products shall be governed by and construed in accordance with the laws of Sweden. Any disputes arising from these Terms will be resolved in the courts of Sweden.

7. Changes to Terms and Conditions

We reserve the right to update, change, or replace any part of these Terms and Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
